Administrative Adjudication

The purpose of Administrative Adjudication is to provide fair and efficient enforcement of Village ordinances as allowed by law.

What is Administrative Adjudication?

Administrative Adjudication is an administrative hearing process which is authorized by law and Village Ordinance to conduct hearings on a wide range of cases which involve contesting citations and violations of Village ordinances. Instead of sending these cases to the Cook County Circuit Court, the Village of South Barrington expedites the resolution of these violations and minimizes the cost associated with sending cases to the Cook County Circuit Court.

Where and When?

Administrative hearings are conducted at the Village of South Barrington in Rose Hall on the first Wednesday of each month at 6:00 p.m.

Who is involved?

The Respondent, whom was issued the violation, and a Code Hearing Unit which is comprised of an Administrative Hearing Officer, Ordinance Enforcement Administrator, Chief of Police (or his designee) hearing room personnel, and any other duly appointed person(s) deemed necessary for the efficient administration of the Code Hearing Unit.

What is an Administrative Hearing Officer?

Administrative Hearing Officer is an attorney licensed to practice law in the state of Illinois for no less than three (3) years and has been appointed by the Village President, with the advice and consent of the Village Board. The Administrative Hearing Officer has successfully completed a formal training program.

What are the Duties and Authority of the Administrative Hearing Officer?

Administrative Hearing Officers are authorized and directed to administer oaths, hear testimony and accept evidence that is relevant to the case, issue subpoenas directing witnesses to appear and give testimony, preserve and authenticate the record of the hearing, including all exhibits and evidence introduced at the hearing, issue a determination in writing and include written findings of fact, decision, and order including the fine, penalty and other action with which the Respondent must comply.

What are the Procedures at the Administrative Hearing?

Parties are provided an opportunity for a hearing during which they may be represented by counsel, present witnesses, and cross examine opposing witnesses. The Administrative Hearing Officer may issue a continuance or determination of judgement.
